Dear Clients,
Earlier today, the Federal Register has uploaded to their portal an unpublished version of the Proclamation on Aluminum Imports Into U.S.; Adjustments (Proc. 10895) and Steel Imports Into U.S.; Adjustments (Proc. 10896). These documents are scheduled to be published on 02/18/2025.
The 2 proclamations were signed by President Trump on February 10, 2025 and reinstate a 25% tariff on all steel imports, and increases from 10% to 25% tariffs of all aluminum imports. These tariffs will apply to goods entered for consumption, or withdrawn from warehouse for consumption on or after March 12, 2025.
By way of summary, Section 232 tariffs were first imposed in 2018, after the Department of Commerce concluded through its investigations under Section 232 of the Trade Expansion Act of 1962, that imports of foreign steel and aluminum products imposed national security. President Trump has the authority under Section 232 to amend any portion of the Proclamation.
Summary of Changes:
1.- Aluminum Imports Into U.S.; Adjustments (Proc. 10895)
Effective date: March 12, 2025
Affected Tariffs
Aluminum Articles:
(i) unwrought aluminum provided for in heading 7601;
(ii) bars, rods and profiles provided for in heading 7604; wire provided for in heading 7605;
(iii) plates, sheets and strip provided for in 7606; foil provided for in heading 7607;
(iv) tubes, pipes and tube or pipe fittings provided for in heading 7608 and 7609; and
(v) castings and forgings of aluminum provided for in subheading 7616.99.51.
Derivative Aluminum Products:
(A) stranded wire, cables, plaited bands and the like, including slings and similar articles, of aluminum and with steel core, not electrically insulated; the foregoing fitted with fittings or made up into articles (described in subheading 7614.10.50);
(B) stranded wire, cables, plaited bands and the like, including slings and similar articles, of aluminum and not with steel core, not electrically insulated; the foregoing comprising electrical conductors, not fitted with fittings or made up into articles (described in subheading 7614.90.20);
(C) stranded wire, cables, plaited bands and the like, including slings and similar articles, of aluminum and not with steel core, not electrically insulated; the foregoing not comprising electrical conductors, not fitted with fittings or made up into articles (described in subheading 7614.90.40);
(D) stranded wire, cables, plaited bands and the like, including slings and similar articles, of aluminum and not with steel core, not electrically insulated; the foregoing fitted with fittings or made up into articles (described in subheading 7614.90.50);
(E) bumper stampings of aluminum, the foregoing comprising parts and accessories of the motor 3 vehicles of headings 8701 to 8705 (described in subheading 8708.10.30); and
(F) body stampings of aluminum, for tractors suitable for agricultural use (described in subheading 8708.29.21).
IN ADDITION to the above listed classifications, articles included in ANNEX 1 have been added to the Section 232 and are subject to the 25% tariff.
Note 1: These rates of duty, which are in addition to any other duties, fees, exactions, and charges applicable to such imported derivative aluminum articles, shall apply to imports of derivative aluminum articles described in Annex I to this proclamation from all countries, except Russia, but shall not apply to derivative aluminum articles processed in another country from aluminum articles that were smelted and cast in the United States.
Russia = 200% tariff
Note 2: For any derivative steel article identified in Annex I that is not in Chapter 76 of the HTSUS, the additional ad valorem duty shall apply only to the steel content of the derivative aluminum article.

2.- Steel Imports Into U.S.; Adjustments (Proc. 10896)
Effective date: March 12, 2025
Affected Tariffs:
Steel Articles
1) flat-rolled products provided for in headings 7208, 7209, 7210, 7211, 7212, 7225 or 7226;
2) bars and rods provided for in headings 7213, 7214, 7215, 7227, or 7228; angles, shapes and sections of 7216 (except subheadings 7216.61.00, 7216.69.00 or 7216.91.00); wire provided for in headings 7217 or 7229; sheet piling provided for in subheading 7301.10.00; rails provided for in subheading 7302.10; fish-plates and sole plates provided for in subheading 7302.40.00; and other products of iron or steel provided for in subheading 7302.90.00;
3i) tubes, pipes and hollow profiles provided for in heading 7304 or 7306; tubes and pipes provided for in heading 7305;
4) ingots, other primary forms and semi-finished products provided for in heading 7206, 7207 or 7224; and
5) products of stainless steel provided for in heading 7218, 7219, 7220, 7221, 7222 or 7223.
Derivative Steel Products
(A) nails, tacks (other than thumb tacks), drawing pins, corrugated nails, staples (other than those of heading 8305) and similar articles, of iron or steel, whether or not with heads of other material (excluding such articles with heads of copper), suitable for use in powder-actuated handtools, threaded (described in subheading 7317.00.30); and
(B) nails, tacks (other than thumb tacks), drawing pins, corrugated nails, staples (other than those of heading 8305) and similar articles, of iron or steel, whether or not with heads of other material (excluding such articles with heads of copper), of one piece construction, whether or not made of round wire; the foregoing described in statistical reporting numbers 7317.00.5503, 7317.00.5505, 7317.00.5507, 7317.00.5560, 7317.00.5580 or 7317.00.6560 only and not in other statistical reporting numbers of subheadings 7317.00.55 and 7317.00.65)
(C) bumper stampings of steel, the foregoing comprising parts and accessories of the motor vehicles of headings 8701 to 8705 (described in subheading 8708.10.30); and
(D) body stampings of steel, for tractors suitable for agricultural use (described in subheading 8708.29.21).
IN ADDITION to the above classifications, articles included in ANNEX 1 have been added to the Section 232 and are subject to the 25% tariff.
Note 1: the additional derivative steel articles covered by this proclamation, as set out in Annex I to this proclamation, shall be subject to the ad valorem duties proclaimed in Proclamation 9705 and Proclamation 9980, except for derivative steel articles processed in another country from steel articles that were melted and poured in the United States.
Note 2: For any derivative steel article identified in Annex I that is not in Chapter 73 of the HTSUS, the additional ad valorem duty shall apply only to the steel content of the derivative steel article.
Exclusions
All previously granted exclusions will be discontinued on March 12, 2025. Including General Approved Exclusions (GAE).

Enforcement for both Proclamations
The EO includes special indications to CBP on the enforcement:
- CBP shall prioritize reviews of the classification of imported steel articles and derivative steel articles and, in the event that it discovers misclassification resulting in non-payment of the ad valorem duties proclaimed herein, it shall assess monetary penalties in the maximum amount permitted by law and shall not consider any evidence of mitigating factors in its determination. In addition, CBP shall promptly notify the Secretary regarding evidence of any efforts to evade payment of the ad valorem duties proclaimed herein through processing or alteration of steel articles or derivative steel articles prior to importation. In such circumstances, the Secretary shall consider the processed or altered steel articles or derivative steel articles for inclusion as derivative steel articles pursuant to clause 5 of this proclamation.
Preparing for this change:
- Review your classifications.
- Review your valuation methods.
- Set up you ACH account with CBP for payment of duties.
- Review your bond sufficiency and forecast accordingly to avoid saturation and stacking liability.

Hoy temprano, el Registro Federal subió a su portal una versión inédita de la Proclamación sobre las importaciones de aluminio a EE. UU.; Ajustes (Proc. 10895) e Importaciones de Acero a EE.UU.; Ajustes (Proc. 10896). Está previsto que estos documentos se publiquen el 18/02/2025.
Las 2 proclamaciones fueron firmadas por el presidente Trump el 10 de febrero de 2025 y restablecen un arancel del 25% sobre todas las importaciones de acero, y aumentos del 10% al 25% de los aranceles sobre todas las importaciones de aluminio. Estos aranceles se aplicarán a los bienes ingresados para consumo o retirados del almacén para consumo a partir del 12 de marzo de 2025.
A modo de resumen, los aranceles de la Sección 232 se impusieron por primera vez en 2018, después de que el Departamento de Comercio concluyera, mediante sus investigaciones en virtud de la Sección 232 de la Ley de Expansión Comercial de 1962, que las importaciones de productos extranjeros de acero y aluminio imponían la seguridad nacional. Aplicación de ambas proclamaciones
La EO incluye indicaciones especiales para la CBP sobre la aplicación de la ley:
CBP dará prioridad a las revisiones de la clasificación de artículos de acero importados y artículos derivados de acero y, en caso de que descubra una clasificación errónea que resulte en la falta de pago de los derechos ad valorem aquí proclamados, impondrá sanciones monetarias en el monto máximo permitido por la ley y no considerará ninguna evidencia de factores mitigantes en su determinación. Además, CBP notificará prontamente al Secretario sobre evidencia de cualquier esfuerzo para evadir el pago de los derechos ad valorem aquí proclamados mediante el procesamiento o alteración de artículos de acero o artículos derivados de acero antes de la importación. En tales circunstancias, el Secretario considerará los artículos de acero procesados o alterados o los artículos derivados de acero para su inclusión como artículos derivados de acero de conformidad con la cláusula 5 de esta proclamación.
