9801.00 USA Origin Merchandise 19CFR10.1

Dear Friends and Customers,

We have seen an increase of CBP inquires for "Evidence of Origin" on Imports of US Goods Returned/USA made merchandise declared under 9801.00 as Free of Duty.

Title 19 CFR 10.1(a)(1) requires a declaration by foreign shipper in substantially the attached format to be filed in connection with the entry of articles in a shipment valued over $2,000 and claimed to be free of duty under subheading 9801.00.10 or 9802.00.20.

For this provision, goods must actually be made in the U.S.A not purchased in the USA.
They cannot have been advanced in value or improved in condition while abroad, they cannot have been subjected to any process of manufacture while abroad, and other additional requirements listed on 19 CFR 10.1.

Importers are required to include the"Foreign Shipper/Importer Declaration (19CFR10.1)". We strongly recommend that you also include evidence of US Origin, such as a Certificate of Origin or Affidavit signed by the manufacturer ,with the import documents.

"Affidavit or Manufacturers Statement" of manufacture must be:

  • On the manufacturers letterhead
  • Signed by the U.S. manufacturer
  • And must include a statement that they produced the goods

You may also provide a "Certificate of Origin" that indicates:

  • The Producer as the US company who manufactured the US good
  • Signed by the Manufacturer or Producer.
