Dear friends and customers,

This is to inform you that on March 23, 2022, USTR announced the Reinstatement of Certain Exclusions from China Section 301 Tariffs.  This determination reinstates 352 of the 549 eligible exclusions; it will apply retroactively to October 12, 2021, and extend through December 31, 2022.

Your company may have imported products that are eligible for this exclusion.  Please identify your products HTSUS classification numbers in the list of qualifying exclusions and determine if your products meet the corresponding scope description in order to qualify.  If your HTSUS is listed, it does not necessarily mean that it qualifies.

We have attached an Excel spreadsheet with the HTSUS classification numbers that are eligible for these exclusions, and a copy of the Federal Register notice for your reference.  U.S. Customs and Border Protection will issue instructions on entry guidance, and we will work with you to implement these instructions.

The reinstated exclusions are available for any product that meets the description in the product exclusion. In particular, the scope of each exclusion is governed by the scope of the ten-digit HTSUS subheadings and product descriptions in the Annex to the notice (this is contained in the attached Excel spreadsheet).  The reinstated exclusions will apply to goods entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. eastern daylight time on October 12, 2021, that are not liquidated or to entries that are liquidated, but within the period for protest described in section 514 of the Tariff Act of 1930, as amended.

Le informamos que el 23 de marzo de 2022, la USTR anunció el restablecimiento de ciertas exclusiones de las tarifas de la Sección 301 de China. Esta determinación restablece 352 de las 549 exclusiones elegibles; se aplicará retroactivamente al 12 de octubre de 2021 y se extenderá hasta el 31 de diciembre de 2022.
 
Es posible que su empresa tenga productos importados que sean elegibles para esta exclusión. Identifique los números de clasificación HTSUS de sus productos en la lista de exclusiones calificadas y determine si sus productos cumplen con la descripción de alcance correspondiente para calificar. Si su HTSUS aparece en la lista, no significa necesariamente que califique.
 
Adjuntamos un archivo de Excel con las HTSUS que son elegibles para estas exclusiones y una copia del aviso del Registro Federal para su referencia. La Oficina de Aduanas y Protección Fronteriza de EE. UU. emitirá instrucciones sobre la guía de entrada y trabajaremos con usted para implementar estas instrucciones.
 
Las exclusiones restablecidas están disponibles para cualquier producto que cumpla con la descripción en la exclusión del producto. En particular, el alcance de cada exclusión se rige por el alcance de los subtítulos HTSUS de diez dígitos y las descripciones de productos en el anexo del aviso (esto se encuentra en el archivo de Excel adjunta). Las exclusiones restablecidas se aplicarán a los bienes ingresados ??para consumo, o retirados del almacén para consumo, a partir de las 12:01 a. protesta descrita en la sección 514 de la Ley Arancelaria de 1930, según enmendada.
